By booking a ride or tour through Kumbai — whether through the app, the website, or over the phone — you're agreeing to the terms below. Kumbai B.V. ("Kumbai," "we," "us") is a locally based platform connecting riders with Curaçao taxi drivers, and connecting travelers with island tours. If any of this doesn't work for you, please don't use the app or site.
Rides and tours marked "Kumbai Driver" are run directly by our own network of local drivers. Tours marked "Partner Tour" are run by independent Curaçao businesses — dive shops, boat operators, ATV outfits, and similar. We connect you to them, but they're the ones responsible for running that specific activity, not us. Booking one of these tours takes you to that partner's own booking page and their own terms.
Some parts of the app require an account, and we ask that the information you give us is accurate. We can suspend or close an account if we have a genuine security, legal, or fraud-related reason to — this isn't something we do lightly, but we do reserve the right to it.
The fare you see before a ride is an estimate. It can shift slightly depending on the route actually taken, traffic, or extra stops along the way. You'll get a receipt by email or in the app after every trip.
Night and public holiday surcharge. This one isn't set by us — it's a rule from the Government of Curaçao under the Landsverordening Personenvervoer and its implementing fare decrees. Fares carry a 25% surcharge between 11:00 PM and 6:00 AM, and on Sundays and public holidays, and this applies island-wide to every licensed taxi, not just Kumbai. Where it applies, it's already reflected in the fare shown before you confirm your ride.
You can pay by credit or debit card in the app (Visa, MasterCard, American Express, local Curaçao cards, and digital wallets where available), or in cash with your driver in XCG or USD.
You're only charged the full fare once the ride is actually finished — never before, and never partially in advance. For cash rides, you pay the driver in full when the trip ends.
Using a card issued outside Curaçao? Make sure international/online purchases are switched on with your bank beforehand, and know that your bank may add its own currency conversion fee on top. Card charges run in XCG.
If a card payment fails, the ride shows as unpaid and your account may be limited until it's settled — we may retry the charge, or pursue it through other lawful means if needed.
Tips are entirely optional, and 100% goes to the driver — whether you tip in the app or hand it over directly.
Promo codes and ride credits have no cash value, can't be transferred or refunded, and need to be applied before the ride is completed.
For preorder rides booked in advance, you can cancel free of charge up to 24 hours before pickup. Cancel closer to your pickup time than that, and a cancellation fee applies.
For instant, on-demand rides, cancellation is no longer possible once your driver has actually arrived — a cancellation fee is charged automatically at that point. Your driver will wait up to 15 minutes after arriving, and may contact you during that window to confirm they're there. If you haven't shown up once those 15 minutes pass, it's treated as a no-show and the full fare applies — the driver isn't required to wait any longer than that.
A few situations aren't eligible for a refund: the ride or tour has already started, the pickup details you gave us were wrong, there's a pattern of repeated cancellations that looks like an attempt to game the system, or the refund request comes in more than 48 hours after the ride.
Where a refund is appropriate — your driver never showed, we or the driver cancelled on you, or the ride genuinely fell short of what you'd reasonably expect (an unsafe vehicle, a driver behaving unprofessionally) — you can ask for one within 48 hours of the ride. We'll look into it and, where it's warranted, get the refund back to your original payment method within about 7 business days, minus any transaction fees that don't come back to us either.
Genuine emergencies — a medical situation, a cancelled or delayed flight, weather bad enough to make travel unsafe — are looked at case by case, and we may ask for some documentation to back it up.
Think a charge or cancellation fee was a mistake? Email info@kumbai.io within 48 hours and we'll take a look — we typically respond within 3–5 business days, though raising it doesn't automatically mean it gets reversed.
Treat drivers, guides, and fellow passengers with basic respect, and follow whatever safety instructions you're given during a ride or activity. Don't try to hack, reverse-engineer, or otherwise mess with the app, use it for anything illegal or deceptive, or try to get into accounts or data that aren't yours. Any of that can get an account suspended or shut down, and we may also pursue any other legal remedy available to us.
The Kumbai name, app, and everything in it belong to Kumbai or whoever we've licensed it from. Using the app gives you permission to use it the way it's meant to be used — nothing more, and it's not something you can hand off to someone else. You may not copy, modify, distribute, or build a competing service from any part of the app or its content without our written permission.
Kumbai provides the app, the booking system, and the connection between riders and drivers — we are a technology platform, not the entity physically providing your transportation. The actual ride is provided by an independently licensed taxi driver under Curaçao's own transport regulations, not by Kumbai.
Drivers on the Kumbai network are independent, individually licensed taxi operators under Curaçao's Landsverordening Personenvervoer (the national ordinance governing passenger transport) — not Kumbai employees, agents, contractors, or representatives. Under that same law, a taxi permit is personally held by the driver, cannot be freely transferred, and requires the permit holder to either drive the vehicle themselves or obtain specific permission for a substitute driver. Kumbai does not issue, hold, or control these permits, and does not direct how a driver drives, the day-to-day condition of their vehicle beyond what their license already requires, or their conduct beyond what's described in these Terms.
Where the law allows it, Kumbai is not responsible for a driver's actions, omissions, or negligence. That said, we take reports of driver misconduct seriously, and may suspend or remove a driver from the platform where warranted.
The app and website are provided "as is" and "as available," without any guarantee — express or implied — that the Service will be uninterrupted, error-free, secure, or that a driver or tour will actually be available at the moment you want one. We don't guarantee the accuracy of estimated fares, arrival times, tour descriptions, or any other information shown in the app, though we work to keep it accurate.
Tours and activities carry real, inherent risk — this is especially true of water-based activities (snorkeling, diving, boat charters, SNUBA, jet-ski or Seabob use) and adventure activities (ATV tours, hiking, off-road excursions). By booking any such activity, you're confirming that you understand and voluntarily accept those risks, including the risk of serious injury, drowning, or death, and that you are physically able to safely take part. If a partner operator requires you to sign their own waiver or liability release before an activity, that is a condition of participating, separate from and in addition to these Terms.
Kumbai is a booking and connection platform. For "Kumbai Driver" rides, Kumbai facilitates the booking and payment, but the driver — as an independent operator — is responsible for the actual driving and the ride itself. For "Partner Tour" activities, the partner operator is solely responsible for running that activity safely, maintaining their own equipment, holding any licenses or permits required by Curaçao law, and carrying their own liability insurance. Kumbai does not inspect, certify, or guarantee the safety practices, equipment, or insurance coverage of any partner operator, and booking through Kumbai does not make Kumbai a party to, or guarantor of, that operator's services.
If a partner operator's conduct, equipment, or negligence causes you harm or loss, your claim is against that operator, not Kumbai. Kumbai encourages every user to confirm a partner's insurance and safety certification directly with that operator before participating in a water-based or adventure activity.
To the fullest extent permitted under Curaçao law, Kumbai, its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost income, lost data, personal injury, or property damage — arising from your use of the Service, a ride, or any tour, even if we've been advised such damages were possible.
Where Kumbai is found liable for anything relating to the Service despite the above, our total liability to you for any single claim, however it arises, will not exceed the amount you actually paid Kumbai for the specific ride or Kumbai-operated tour giving rise to that claim. This cap does not apply to liability that cannot legally be limited or excluded under Curaçao law, such as liability for death or personal injury caused by our own gross negligence or intentional misconduct.
If your use of the Service, your violation of these Terms, or your actions during a ride or tour cause a claim, loss, or expense against Kumbai — including reasonable legal fees — you agree to indemnify and hold Kumbai harmless for that claim, to the extent it results from your own actions, negligence, or breach of these Terms.
Kumbai is not responsible for delays, cancellations, or service interruptions caused by events beyond our reasonable control — severe weather, natural disasters, government action, power or network outages, strikes, or similar circumstances. Where such an event affects a ride or tour, we'll do what we reasonably can to help, but we're not liable for the disruption itself.
These Terms follow the laws of Curaçao. Any dispute that can't be resolved directly with us will be submitted to the competent courts of Curaçao, which will have exclusive jurisdiction, unless a mandatory consumer protection law says otherwise. Before filing a claim, we ask that you first contact info@kumbai.io so we have a real opportunity to resolve the issue directly.
If a court finds any part of these Terms unenforceable, the rest of the Terms still stand — only the unenforceable part is affected, and it will be replaced with a valid provision that reflects the original intent as closely as possible. If we don't act on a particular breach right away, that doesn't mean we're giving up our right to act on it, or any other breach, later.
We may update these Terms from time to time as the business grows. If you keep using Kumbai after an update goes live, that counts as accepting the new version.
