1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a binding agreement between Kumbai B.V. ("Kumbai," "we," "our," or "us") and any individual or entity accessing or using our mobile and web applications, software, and services (collectively, the "Service"). By using the Service, you agree to these Terms in full. If you do not accept these Terms, you must immediately stop using the Service.

2. What Kumbai Provides

Kumbai is a locally based platform connecting riders with Curaçao taxi drivers and connecting travelers with island tours. Rides and tours marked "Kumbai Driver" are operated directly by Kumbai's own driver network. Tours marked "Partner Tour" are operated by independent third-party businesses — Kumbai facilitates the connection but is not the operator of those specific activities.

3. Partner-Operated Tours

For any tour operated by a third-party partner, responsibility for safe operation, equipment, guiding, cancellations, and refunds for that specific activity rests with that partner, not Kumbai. Booking such a tour redirects you to the partner's own booking system and terms.

4. Account Obligations

Certain features require an account. You agree to provide accurate, up-to-date information. Kumbai reserves the right to refuse, suspend, or terminate accounts for security, legal, or ethical reasons, including fraud, misuse of the platform, or attempts to bypass its normal use.

5. Fares & Fare Estimates

The fare shown before a ride is an estimate. The final fare may vary depending on the route taken, traffic conditions, or extra stops and waiting time. A receipt is issued after each trip via email or in-app.

Night and public holiday surcharge. In accordance with rates set by the Government of Curaçao, fares are subject to a 25% surcharge between 11:00 PM and 6:00 AM, and on Sundays and public holidays. This surcharge is not set by Kumbai and applies island-wide to all licensed taxi services under government fare regulations. Where it applies, it is reflected in the fare shown before you confirm your ride.

6. Payment

Payment methods. Kumbai accepts credit/debit card payment in the app (local Curaçao cards, Visa, MasterCard, American Express, and digital wallets where available, processed through our PCI-compliant payment system), or cash directly with your driver in XCG (Caribbean Guilder) or USD.

When you're charged. The full fare for a ride is charged only once the ride has been completed — not before, and not partially in advance. For cash rides, payment is due in full to the driver at the end of the trip.

International cards. If using a card issued outside Curaçao, enable international/online purchases in advance and note that your bank may apply a currency conversion fee. Charges are made in XCG.

Failed payments. If a card payment fails, the ride is marked unpaid and your account may be restricted until the balance is cleared. Kumbai may retry the charge or pursue collection through other lawful means if necessary.

Tips. You may tip your driver in the app after a card ride, or in cash directly. 100% of tips go to the driver.

Promotions. Promo codes and ride credits are non-refundable, non-transferable, have no cash value, and must be applied before the ride is completed.

7. Cancellations & No-Shows

Preorder (scheduled) rides: You may cancel free of charge up to 24 hours before the scheduled pickup time. Cancellations made within 24 hours of a scheduled pickup are subject to a cancellation fee.

Instant (on-demand) rides: Once your driver has arrived at the pickup location, the ride can no longer be cancelled — the system will automatically charge a cancellation fee. On an instant ride, your driver will wait up to 15 minutes after arrival. During this window, the driver may contact you to confirm and let you know they've arrived. If you are not present when the 15 minutes elapse, it is treated as a no-show and the full fare is charged; the driver is not obligated to wait beyond this window.

Non-refundable situations include: the ride or tour has already started; incorrect pickup information was provided; repeated cancellations or attempts to exploit the platform; or a refund request submitted more than 48 hours after the scheduled service.

Refund eligibility: you may request a full or partial refund within 48 hours of your scheduled service if the assigned driver failed to arrive, the booking was cancelled by Kumbai or the assigned driver, or the service did not meet reasonable expectations (unprofessional conduct, unsafe vehicle, etc.). Refunds are issued at Kumbai's discretion following investigation, typically within 7 business days to the original payment method, less any applicable transaction fees.

Force majeure: refunds or waivers may be granted case-by-case for verified medical emergencies, flight cancellations/delays, or severe weather and other events making travel unsafe. Documentation may be requested.

Disputes: if you believe a cancellation fee or charge was applied in error, email support@kumbai.io within 48 hours of the booking. We investigate and respond within 3–5 business days; a review does not guarantee a reversal.

8. Conduct & Prohibited Use

Riders and tour participants must treat drivers, guides, and other passengers respectfully and follow safety instructions. Users may not hack, reverse-engineer, or interfere with the Service; use it for illegal or deceptive purposes; violate third-party rights; or attempt unauthorized access to accounts or data. Violations may result in account suspension or termination.

9. Intellectual Property

All trademarks, software, and content associated with the Service belong to Kumbai or its licensors. Users are granted a limited, non-exclusive, non-transferable, revocable license to use the Service as intended — nothing more.

10. Limitation of Liability

The Service is provided "as is." Kumbai facilitates bookings but is not liable for the acts, omissions, or performance of independent third-party tour operators. Use of any activity, especially water-based or adventure tours, is at the participant's own risk, subject to that operator's own safety and liability terms. To the fullest extent permitted by law, Kumbai is not liable for indirect, incidental, or consequential damages.

11. Governing Law

These Terms are governed by the laws of Curaçao. Any disputes shall be resolved in the courts of Curaçao, unless otherwise required by mandatory local consumer protection law.

12. Changes to These Terms

Kumbai may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
